Group Litigation

Sometimes when something goes wrong it happens to a large number of people at the same time or over a period of time. If the circumstances allow it, those people will all join together in a legal action against the person or business who was at fault. This is called group litigation.

Group litigation can be justified in a number of different circumstances, and once a Group Litigation Order has been made, then each case will be allocated to that order and will be heard by one court.

What types of group litigation are there?
There many different types of group litigation, and there are a number of reasons why you would want to be included in a group action.

If, for example, a solicitor had under settled a large number of personal injury cases on behalf of their clients, those clients may all join together to bring a group litigation against the original law firm for professional negligence. 

Another example of a group litigation would be where a number of employees had all been exposed to asbestos whilst working for the same employer over a period of time. These employees may join together in a group litigation to recover compensation from their past employer.

If there was an outbreak of food poisoning on a cruise ship the passengers may bring a group action against the holiday company for compensation. 

Bringing a group litigation claim under circumstances such as those set out above, can lead to the individuals affected receiving their compensation sooner and at less cost than might otherwise be the case.
