Upcoming changes following the 122nd Update - Practice Direction Amendments

For those who produce expert reports as well as those who instruct such experts, you may wish to take note of the forthcoming changes which will come into force on 1 October 2020 as a consequence of the 122nd Update - Practice Direction Amendments.

Amongst the various changes, there is a change to the statement of truth which now requires an additional paragraph as follows:

“I understand that proceedings for contempt of court may be brought against anyone who makes or causes to be made, a false statement in a document verified by a statement of truth without an honest belief in its truth”.

Experts may consider it prudent to start using the additional paragraph straight away and those of you who instruct experts may wish to inform them of this new requirement in all new cases as well as any ongoing matters.

The new declaration in full is as follows:

 "I confirm that I have made clear which facts and matters referred to in this report are within my own knowledge and which are not. Those that are within my own knowledge I confirm to be true. The opinions I have expressed represent my true and complete professional opinions on the matters to which they refer. I understand that proceedings for contempt of court may be brought against anyone who makes, or causes to be made, a false statement in a document verified by a statement of truth without an honest belief in its truth”.
